Illinois assault weapons ban upheld by federal appeals court in Chicago, which finds no violation of 2nd Amendment – Chicago Sun-Times

“Even the most important personal freedoms have their limits,” Judge Diane P. Wood wrote in the court’s highly anticipated opinion. “Government may punish a deliberately false fire alarm; it may condition free assembly on the issuance of a permit; it may require voters to present a valid identification card; and it may punish child abuse even if it is done in the name of religion. The right enshrined in the Second Amendment is no different.”

  1. This decision stands in direct contrast to those made by judges in several other states within the past year. I agree with the sentiment that this issue will eventually be brought before the Supreme Court and hope that they agree with Judge Wood who presided over this case. I particularly agree with the following aspect of the court’s opinion: “Even the most important personal freedoms have their limits,” which was supported by several examples of accepted limits that have been placed on the most quintessential of American civil rights and liberties. Do you think this issue will be ruled on by the Supreme Court? What decision do you think they would make?

    1. Hey Bree, I completely agree with Judge Woods ruling. This ruling was not like many of the other rulings in different states recently. I do think this issue will be ruled by the Supreme Court sooner than later. With all of the laws different states have been ruling on lately it will definitely go to the Supreme Court. Like the article states the law can punish those who do certain things such as punishing a child in a religious way can constitute as child abuse. Just because it is a part of there religion does not mean they cannot be punished by the law. Sadly I do not believe the Supreme Court will rule in favor of Judge Wood’s ruling. I say this because a majority of the states who are dealing with similar situations have not ruled in the same way as Judge Wood. Hopefully the Supreme Court will, I just don’t know how likely that would be.

  2. This article sheds light on what I think is an important topic. Military grade firearms have caused so many issues in the US and I really see no need for them in the arms of civilians. They’ve been used in mass shootings and killings and theres no need for them on the streets. The 2nd amendment was made way back when people needed the right to bear arms pre armies. I’m wondering if this is going to be something other states take a look at? If so, I think it could help prevent some serious gun violence from occurring.
